I don't want Asha Bhosle's garden: Sadhana
Last year, the cops investigating the case went as far as calling her a liar, and earlier this month, singer Asha Bhosle, who owns the bungalow, filed a police complaint against her for allegedly encroaching on her property. Cornered from all sides, Sadhana Nayyar has finally broken her silence on the issue.
Speaking to Mirror on Asha Bhosle's police complaint against her, Sadhana said that she has been staying at the ground floor of the 9,750 sq ft bungalow - Sangeeta - for over 50 years. She said that she has never stopped Bhosle from using the garden, as alleged in the singer's complaint against her in the Santa Cruz police station.
"I only told Ashaji once that I need to be informed about people who are being sent by her to see the place. They are most welcome but how can I allow strangers inside my house?" she asked.
Sadhana said that while she has been taking care of the garden for all these years, she has no ambitions to taking over the garden. Speaking on the issue, advocate Viram Trivedi of Manilal Kher Ambalal& Co.
, who is representing Asha Bhosle, said that he would not like to comments on this matter at this stage. "Even if my house goes for redevelopment along with the bungalow, all I want is a space equivalent to my existing house in the new scheme.
I am not against any form of redevelopment or sale of the property," Sadhana said, speaking on accusation that she is resisting the redevelopment/sale of the bungalow. The matter first came to public glare on August 10, 2010, when Sadhana filed an FIR at Santa Cruz police station against Yusuf Lakadawala , a fellow tenant and prominent builder, accusing him of entering her house and threatening her.
She also alleged that Lakadawala was trying to force her out of the bungalow so that he could put the house up for redevelopment. "That day, Lakadawala had taken the keys to the terrace where the society's water tanks are kept.
Since there was problem with water that day, I called him and asked him to send the keys. After waiting for a long time, I called again.
But Lakadawala landed at my residence with a group of people and threatened me," Sadhana told Mumbai Mirror. "When I went to meet DCP Prasanna on August 9, he asked me to wait.
It was only next day that I got a call from Santa Cruz police station senior police inspector who asked me to come there and file the FIR," she said. Lakadawala was arrested in November 2010 and let off on bail later.
He then approached the Bandra Metropolitan Magistrate, claiming that he had been falsely implicated and defamed by Sadhana. Cops investigating the case, in their report to the court, submitted that Sadhana's complaint was false as her cell phone location showed that "she was not at home at the time Lakadawala allegedly threatened her".
"They said that I had given a false report because I wasn't home between 1.28 pm and 2.
10 pm. I never said that he was there at that time.
My complaint clearly mentions that Lakadawla was at my residence between 2.15 pm and 2.
30pm on August 9," she said. (A copy of the FIR is with Mumbai Mirror).
Is Lakadawala a legal tenant? In a letter submitted to Santa Cruz police station in 1985, a certain Nilam Kashyap claimed that her husband and not Lakadawala is the real tenant of Sangeeta's second floor. The letter stated that her family was staying at the bungalow till 1984, when they shifted to Pali Hill.
"We are still paying rent through court to Asha Bhosle as she has given notices to all the tenants to vacate the premises of Sangeeta bungalow," the letter added. The letter also stated that Lakadawala was a friend of her husband and had showed willingness to be the care taker of the flat after they shifted.
Advocate Vibhav Krishna, who represents Yusuf Lakadawala, said, "We have filed the defamation suit based on the police reports. Everything is documented.
As for Lakdawala being the tenant or not on the second floor, we maintain that he is the legal tenant of the said floor. Beyond that we would not like to say anything because the matter is being contested in the court.
" Asha Bhosle not sole owner While Asha Bhosle is the legal owner of the prime property at the cusp of Santa Cruz and Khar, there is another Asha who has equal stakes in the property. The bungalow was originally owned by the legendary singer's former husband Ganpatrao Bhosle, who died in February 1966.
Ganpatrao and the singer had parted ways in 1959. In 1963, he remarried one Ashabai.
When Mumbai Mirror spoke to Ashabai she said that according to a 1969 court order the property was to be sold and divided into eight equal shares, her and Asha Bhosale being two of them. "I do not even know what is happening on that property now.
All I ask for is a fair share for me and my children," she said

Bhosle has given a written application (copy with MiD DAY) to the police alleging that the actress is encroaching on land in the bungalow she owns. The 70-year-old actress lives as a tenant at Sangeeta bungalow in Khar (W), which is owned by Bhosle.
Besides Sadhana, there are two other tenants in the house, one of them being Yusuf Lakdawala, with whom Sadhana had an ugly public spat in 2010. Now the actress is fighting over the garden in the bungalow located at Ramkrishna Mission Road.
In Bhosle's complaint to the Santacruz police station, she has alleged that Sadhana, a tenant in the bungalow, is forcefully encroaching on the garden area. She also alleged that Sadhana didn't let her go to the garden when she went to visit, saying that the area was hers.
Asha Bhosle said in her complaint, "Sadhana is only a tenant and the garden area belongs to me; I am the owner." She added that after her attempts to resolve the dispute failed, she approached the police.
Sadhana has stayed in the bungalow for more than 50 years. DCP (Zone IX) Pratap Dighavkar said, "We received the letter from the singer.
We will now record both their statements. After taking their statements we will investigate the matter, but it is a civil case.
" Despite repeated attempts, Sadhana remained unavailable for comment. Old troubles Earlier, Sadhana had got into a dispute with neighbour Lakdawala.
The 68-year-old actress, known for lead roles in films like Mera Saya and Woh Kaun Thi , resides on the ground floor of Bhosle's two-storey bungalow, while Lakdawala stays on the second floor. In August 2010, she lodged a complaint with the Santacruz police, alleging that Lakdawala had threatened to kill her if she did not vacate her rented 3,000-sq ft flat.
Following this, Lakdawala was arrested in November 2010 and let off on bail a day after. He then approached the Bandra Magistrate Court claiming that he had been falsely implicated and defamed by Sadhana, and that he had never threatened the actress.
After verifying mobile phone data from both parties, police submitted a report stating that the complaint filed by the actress appeared to be false. Tweet

Sadhana, 70, known for her roles in films like 'Mera Saya', 'Woh Kaun Thi' and 'Hum Dono', has been staying on the ground floor of the two-storeyed 'Sangeeta' bungalow owned by Bhosle. Besides Sadhana, builder Yusuf Lakdawala stays on the second floor whereas actress Baby Naaz lives on the first floor, police said, adding all the three are tenants.
"Sadhana Nayyar is the tenant in respect of the ground floor premises only. However, she is wrongly claiming tenancy in respect of the garden abutting the ground floor premises in Sangeeta bungalow by restricting free and unhindered access to the garden to me and my representatives/servants/agents.
The said garden is in my possession," Bhosle said in a complaint to Santa Cruz police station last month. "My uninterrupted lawful possession of the said premises is now being sought to be disturbed with malafide intentions by Sadhana on a false pretext and by obstructing and interfering with the entry/access to the premises by her representatives/servants/agents," Bhosle said.
The 78-year-old singer said she had asked the police to file an FIR and take immediate action against Sadhana over her alleged claim of tenancy in respect of the garden. "The garden was never let out to her.
The same always remained in my possession," Bhosle stated in the complaint

Sadhana had in August 2010 lodged a complaint with the Santa Cruz Police accusing Lakdawala of issuing death threats and trying to force her to vacate her 3000 sq ft house. Sadhana has lived in this house for over 50 years, as a tenant of Asha Bhosle.
Following the complaint, Lakdawala was arrested in November and let off on bail after a day. In October 2011, Sadhna was arrested and later released on bail in connection with a defamation case filed by builder Yusuf Lakdawala.
Sadhna met Maharashtra Home Minister R R Patil last year for unbiased mediation in her property dispute. Sadhna alleges she is being threatened by Lakdawala, who wants to evict her from the house she has been living as a tenant for decades (owned by Asha Bhosle).

" Azmi, 61, was presented with the proclamation by Patricia Kaufman, Executive Director of Motion Picture and Television Development from the office of New York Governor Andrew Cuomo as well as with a 'Certificate of Special Congressional Recognition' by New York Congresswoman Carolyn Maloney. The proclamation also applauded her work as a social activist, noting that apart from being a "highly respected" advocate for social justice, she has worked tirelessly for other causes, including funding for displaced Kashmiri migrants and relief for victims of the Latur earthquake.
"Coming from the city's council in recognition of my work in cinema is obviously something that makes me very happy," Azmi said. The proclamation added that her presence on the board of the arts organisation Indo-American Arts council (IAAC) has inspired hundreds of Indian film makers in the New York area for over a decade.
"Shabana Azmi's talent has garnered international acclaim, helping to shape the Indian film industry and build awareness of Indian cinema in North America," Kaufman said at the ceremony here attended by several prominent members of the Indian American community. Describing Azmi as a "woman of extraordinary achievement hailing from a country rich in culture and traditions,"Kaufman extended Cuomo's wishes to her on receiving the honour.
Azmi has served as an advisory board member of the annual New York Indian Film Festival, established by the IAAC in 2000. The annual film festival, which brings together feature films and documentaries from and about the Indian subcontinent, will be held this year from May 23 to 27.
Azmi lauded the IAAC and its co-founder Aroon Shivdasani for creating a space in North America for Indian and diaspora-related films. "This is the 100th year of Indian cinema and any effort that can be made to strengthen its visibility anywhere in the world is something that I welcome very greatly.
"The fact that the New York City Council recognises my work in cinema becomes a means of saying that Indian cinema is what we recognise because I am who I am because of my first primary identity of being an Indian film actor. It becomes a peg on which you can create greater visibility.
" Azmi fondly recalled her association with New York city, the cosmopolitan character and buzz of which reminds her of Mumbai. She was the only Asian actor to be honoured with a retrospective of her films at the 40th New York Film Festival in 2002.
The five-time National Award winner was this year named recipient of the Padma Bhushan, India's third highest civilian award. Azmi has won accolades in India and across the world for her films like Ankur , Arth , Masoom , Godmother and Fire .
Her repertoire of international work includes John Schlesinger's Madame Sousatzka , Nicholas Klotz's Bengali Night , Roland Joffe's City of Joy , and Blake Edwards' Son of the Pink Panther . She is currently working on Mira Nair's The Reluctant Fundamentalist .
Azmi said the awards and honour are a "bonus" for the truthfulness with which she performs her work. "It would be a mistake to work in a film hoping that this is going to give me a national award or an Oscar because then you would not be working with truthfulness.
If you are truthful to your work then dividends will flow naturally," she said, adding that this is a lesson she has learnt from her parents, legendary poet Kaifi Azmi and actor Shaukat Kaifi. Having herself vowed audiences across the globe with her stellar performances, Azmi says it is Vidya Balan from the current crop of Indian actors who has impressed her the most with her work.
Balan has done five films in a row which are very different from each other, making some very courageous choices, she said adding that Balan's films are those which would not necessarily be embraced by the mainstream cinema. "I watch her work closely and am very impressed with her," she said.
Beaming with pride for Farhan and Zoya Akhtar, Azmi was also full of praise for the brother-sister duo and the accolades and awards the two have been receiving for their movies. She said it is not everyday that parents see both their children vying for the award for best director and best film, referring to Farhan's movie Don 2 and Zoya's film Zindagi Na Milegi Dobara , with both being nominated for the Filmfare Award for best Director this year.

According to Santacruz police, she alleged that the builder, Yousuf Lakdawala, threatened her saying she would be killed and her body parts would not be found after her murder. Last week, the actress met the Police Commissioner Sanjeev Dayal.
